1. Scope

The operator of this website is Swiss Sabers GmbH. If on this website terms such as ‘we’, ‘us’, or ‘our’ are used, they refer to Swiss Sabers GmbH, which offers its services internationally under the name Sabers and Cloaks. Sabers and Cloaks provides you, the user, with this website, including all information, tools, and services available on this website, subject to your acceptance of all of the terms, conditions, policies, and notices set out here.

For all orders placed through our online shop, the following Terms and Conditions apply. Our online shop is exclusively intended for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. A business is any natural or legal person, or any partnership with legal capacity, that acts in the course of its commercial or independent professional activity when entering into a legal transaction.

2. Place of Jurisdiction

Swiss law applies exclusively, excluding the conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich.

3. Products and Prices

Product images in advertisements and videos are for illustrative purposes and are not binding. The product images in the online shop are intended to be depicted as realistically as possible.

All prices are in euros and include all fees for shipping, packaging, and payments.

Price changes and pricing errors are subject to change. We reserve the right to change the prices of the products offered at any time. The price shown in the online shop at the time of the order is what determines the formation of the purchase contract.

4. Guarantee, Warranty, and Returns

We grant you a 14-day right of withdrawal for all products. In the event of damage before or during shipping, you are entitled to a replacement of the affected items. If, at the time of making a guarantee claim, no replacement is available, customers may request a refund of the purchase price or an equivalent replacement product at the same price. The damaged item must always be returned.
In addition, we offer a 14-day return right. Customers may exercise their return right within 14 days after receiving the item (delivery date), provided the item is unused, in its original condition, and free of defects.

Under Swiss law, we provide a guarantee of 2 years from receipt of the lightsaber for the hilt and the components contained therein (in particular the ‘soundboard’ or the ‘core’).
The blade and the battery are considered wear parts and may be damaged during use (in particular the blades during dueling). Therefore, there is no guarantee for blades and batteries unless a defect exists upon receipt.

In the event of defects that arise after the guarantee period has expired, a repair or replacement may be requested as a goodwill gesture. However, Sabers and Cloaks reserves the right to refuse this claim.

5. Liability

The purchase contract is concluded with Sabers and Cloaks, the international distribution company of Swiss Sabers GmbH.

By listing the products in the online shop, we submit a binding offer to enter into a contract for these items. The contract is formed when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email again.

We are liable for claims arising from damage caused by us, our legal representatives, or our vicarious agents

• in cases of injury to life, body, or health,
• in the event of a breach of duty intentionally or grossly negligently,
• for any guarantee promises, insofar as agreed, or
• to the extent that the scope of the Product Liability Act is opened.

In the event of breach of material contractual obligations, the proper performance of the contract is only possible in the first place and on whose compliance the contracting parties may regularly rely (cardinal obligations), liability is limited to the amount of damage foreseeable at the time the contract is concluded, with which typical must be expected to arise, caused by us through simple negligence.
Otherwise, claims for damages are excluded.

6. Delivery, Shipping, and Pickup

All our prices include shipping costs and VAT.

Sabers and Cloaks ships worldwide with reliable partners such as Post, DHL, Hermes, FedEx, or similar shipping service providers.

For deliveries to Germany and Austria, the delivery time is generally 1 to 3 business days after receipt of the order. For international shipping to other countries, delivery times may differ.

We do not assume any liability for delivery delays caused by the shipping service provider.

For items that are currently not in stock (labeled «Not in stock»), a delivery period of more than 3 business days should be expected. The buyer acknowledges that delivery delays do not entitle them to refuse acceptance of the ordered goods.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to file a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the freight carrier and/or the transport insurance.

By continuing to use our website or the service after publication of changes to these Terms and Conditions, or by continuing to access it, this is considered acceptance of these changes.
